A Third J&J Bankruptcy Attempt Won’t Resolve Victims’ Talc Claims

In my many years as an attorney seeking to protect consumers from defective products, I’ve never felt a responsibility as heavy as the one I bear for the thousands of women suffering from ovarian cancer and mesothelioma, conditions linked to Johnson & Johnson’s tainted talc products. The profound pain and suffering they and their families endure is immeasurable.

Dozens of peer-reviewed scientific studies have revealed the correlation between talc use and these devastating diseases, with evidence pointing to the disturbing presence of asbestos, a notorious carcinogen, within talc.

Rather than acknowledge the mounting scientific evidence and provide fair compensation to the victims, J&J resorted to evasion and legal trickery.

By adopting the disreputable and now notorious Texas Two-Step bankruptcy strategy, J&J did a major disservice to both victims and J&J shareholders.

If the company’s bankruptcy scheme had succeeded, it would’ve been a gross miscarriage of justice. Victims would be robbed of their rightful day in court and forced to accept grossly inadequate compensation.

This maneuver by J&J was a gamble on perceived vulnerabilities within our multi-district litigation system. The wheels of justice often turn slowly, and J&J’s bankruptcy strategy brought the process to a screeching halt.

Ex-Trump DOJ lawyer Jeffrey Clark hit with legal ethics charges over post-election role

Jeffrey Clark, a former Justice Department attorney at the center of former President Trump’s attempt to overturn the 2020 election results, was hit Friday with ethics charges alleging that his role in the post-election effort amounted to a breach of legal ethics.

The charges, filed by the District of Columbia Bar Office of Disciplinary Counsel, sets in motion disciplinary proceedings over allegations that Clark engaged in dishonest conduct and sought to interfere with the administration of justice and will culminate in findings that could affect Clark’s D.C. law license.

Clark, who specialized in environmental law at the Justice Department, clark-draft-letter.html”attempted to send a letter to Georgia officials pushing the state to suspend certification of its 2020 election results until the Justice Department investigated fraud claims, despite agency leaders saying such claims were without merit.

After former Attorney General William Barr resigned in December 2020, Clark pushed Trump to nominate him to lead the Justice Department and pursue the president’s false election claims.

Clark said that if selected as acting attorney general he would send the letter to state legislatures, despite warnings from fellow Justice Department lawyers about incorrect information.

‘Tennessee Justice Bus’ to bring legal advice to rural communities

NASHVILLE, Tenn. (WTVF) — The Tennessee Supreme Court has a new program to bring legal help to rural and disadvantaged communities through the Tennessee Justice Bus.

The bus is filled with computers, a printer, internet access, video displays, and other office supplies.

Lawyers and volunteers will be able to provide on-the-spot access to legal help and meet Tennesseans where they are to address the technology gap many rural and disadvantaged citizens face.

Access to Justice has been one of the Tennessee Supreme Court’s top priorities.

They said contrary to popular belief, people are not guaranteed access to an attorney when they encounter civil legal issues.

People who can’t afford an attorney are left to handle a variety of legal issues on their own like evictions, child custody, debt and credit issues, and unfair labor practices.

The bus will help fill the gap.

The Tennessee Justice Bus will officially launch Monday morning in downtown Nashville.

The Tennessee Justice Bus will travel the state to provide pop-up legal services where needed. These legal clinics and community events are commonly held in conjunction with legal aid providers, churches, nonprofit organizations and public service providers
